Car Insurance in Florida

What you need to know

Mandatory Requirement in Florida

Florida is a "no-fault" state, which means that in the event of an accident, each driver files a claim with their own insurance company, regardless of who caused the accident.

This system applies to certain types of coverage (especially PIP), but it does not exempt anyone from civil liability if it causes serious damage, permanent injuries, or fatalities.

📌 Ley clave:

Section 324.021(7), Florida Statutes

Financial Responsibility Law

Personal Injury Protection Law (PIP)

Since 2019, additionally, if you have a car registered in Florida, you must maintain active insurance coverage at all times —even if the vehicle is not in use— or risk fines, suspension of your registration, and your driver's license.

⚖️ Seguro mínimo obligatorio en Florida

To legally register a vehicle in Florida, you must have at least the following coverages:

COVERAGE

MÍNIMO REQUERIDO

PIP (Personal Injury Protection)

$10,000

PDL (Property Damage Liability)

$10,000

🔹 PIP covers:

Up to 80% of medical expenses and 60% of lost income after an accident (up to $10,000), for you and your passengers, regardless of who is at fault.

It only applies if you seek medical treatment within the first 14 days after the accident.

🔹 PDL covers:

Property damage that you cause to third parties (for example, the other driver's car, a fence, a pole).

⚠️ Important:

❌ Florida does NOT require bodily injury liability coverage (Bodily Injury Liability – BI) by law —but that doesn’t mean you don’t need it. Without it, you are responsible out of pocket if you seriously injure someone.

✅ Recommended insurance (for real protection)

The legal minimum is not sufficient in most cases. A serious accident can easily generate medical costs and lawsuits that exceed $100,000.

Recommendation for minimum smart coverage in Florida:

COVERAGE

RECOMMENDED AMOUNT

Bodily Injury Liability (BI)

$25,000 / $50,000 (por persona / por accidente) — mejor aún:

$100,000 / $300,000

Property Damage Liability (PDL)

$25,000 (since $10,000 falls short for modern repairs)

PIP

$10,000 (mandatory) — but consider

expanded limit if your health plan is limited

Uninsured/Underinsured Motorist (UM/UIM)

Altamente recomendado

— ~1.25 million drivers in FL are driving without insurance or with insufficient coverage

Comprehensive and collision coverage

Optional, but essential if your car has commercial value (especially if it is financed or leased)

If you have significant assets (home, savings, investments), consider an umbrella policy of $1M+ to protect yourself against larger lawsuits.

The minimum requirement in Florida allows you to drive legally, but it doesn't really protect you. Investing in more robust coverage is a wise —and responsible— financial decision that can save you from an economic crisis in the event of an accident.

🛡️ In Florida, driving without insurance is like sailing without a life jacket: legal when the waters are calm… but dangerous when the waves come.
