Immigration status to qualify for the Marketplace

Important update for DACA beneficiaries and consumers with certain other immigration statuses


Due to a court order issued on December 9, 2024, beneficiaries of Deferred Action for Childhood Arrivals (DACA) and consumers with certain other immigration statuses listed below are no longer eligible for Marketplace coverage if they live in these states: Alabama, Arkansas, Florida, Idaho, Indiana, Iowa, Kansas, Kentucky, Missouri, Montana, Nebraska, New Hampshire, North Dakota, Ohio, South Carolina, South Dakota, Tennessee, Texas, and Virginia. (DACA beneficiaries and consumers with certain other immigration statuses who do not live in one of those states are not affected).


Do not select "yes" on the application question that asks if you have an eligible immigration status if:

Lives in one of those states and was granted Deferred Action Status as a recipient of Deferred Action for Childhood Arrivals (DACA); or

You live in one of those states and have one of these specific immigration statuses or authorities:

No citizens with certain approved employment-based immigrant visa petitions who are transitioning from a non-immigrant employment-based status to a legal permanent resident (LPR) status, and their spouses and children, for whom immigrant visa numbers are not yet available.

Family Unity Beneficiary under Section 1504 of the Legal Immigration and Family Equity (LIFE) Act Amendments

Adjustment of status to lawful permanent resident (LPR/green card holder) without an approved immigrant visa petition

Special Immigrant Juvenile (SIJ) classification for minors who only have an approved petition for SIJ (and do not have a pending application for adjustment of status)

Children under 14 years old with a pending application for asylum, for Suspension of Deportation, or Suspension of Expulsion under immigration laws or under the Convention Against Torture (CAT), whose application has been pending for less than 180 days

This is a preliminary decision from the court, and final decisions may affect your eligibility for coverage. Check for updates before January 15, when open enrollment for the Marketplace ends.

Individuals with non-immigrant status include worker visas (such as H1, H-2A, H-2B), student visas, U visas, T visas, and other visas.

Deferred Action Status, including beneficiaries of Deferred Action for Childhood Arrivals (DACA) (in certain states)

Cuban/Haitian participant

Conditional entry granted before 1980

Abused spouse, child, or parent

Victim of trafficking and their spouse, child, sibling, or parent

Special Immigrant Visa Holders from Iraq or Afghanistan

Stay of deportation or stay of expulsion granted, in accordance with immigration laws or in accordance with the Convention Against Torture (CAT)

Self-petitioners under the Violence Against Women Act (VAWA)

Member of a federally recognized indigenous tribe or American Indian born in Canada

Citizens of the Marshall Islands, Micronesia, and Palau who live in one of the states or territories of the U.S. (referred to as Compact of Free Association migrants or COFA)

Legal temporary resident

Temporary Protected Status (TPS)

Deferred Forced Exit (DED)

Special classification of immigrant minors​

Family Unity Beneficiary, including those who are under section 1504 of the Legal Immigration and Family Equity (LIFE) Act (in certain states)


Applicant for certain statuses

Adjustment of Status to Legal Permanent Resident (LPR/Green Card Holder) (in certain states)

Visa for victims of human trafficking

Children under 14 years old with a pending asylum application, Suspension of Deportation, or Suspension of Expulsion under immigration laws or under the Convention Against Torture (CAT) (in certain states)
